Authorities Worldwide Highlight Risk Around Investments
[Alabama Securities Commission] Last October, the Board of the International Organization of Securities Commissions (IOSCO) discussed the growing usage of Initial Coin Offerings (ICOs) to raise capital as an area of concern. “There are clear risks associated with these offerings,” IOSCO had warned all nations in a statement after the discussions. The world body also said that ICOs are highly speculative investments in which investors were putting their entire invested capital at risk. To be fair, some operators provide legitimate investment opportunities to fund projects or businesses. But, the increased targeting of retail investors through online distribution channels by parties often located outside an investor’s home jurisdiction — which may not be subject to regulation or may violate laws — “raises investor protection concerns.”

Finra Fights to Overturn Merrill Broker’s Expungement Victory
[Alabama Securities Commission] The Financial Industry Regulatory Authority is accusing a Merrill Lynch broker who won expungement of seven customer complaints last summer of “forum shopping” and of “fraudulent manipulation” of the arbitration process. In a relatively rare filing, the industry-funded self-regulatory organization asked a Florida court to vacate an arbitration panel’s unanimous decision in July in favor of Patrick J. Dwyer, a Miami, Fla.-based broker whose 11-person private banking and investment group team regularly ranks as a “top” national advisory team in wealth management publications. Dwyer has filed a petition with the same circuit court of the 11th Judicial Circuit in Miami to confirm the arbitration award made by the Finra-sponsored panel, as required under Finra arbitration procedures.

Gov. Ivey awards grant to support innovation in Alabama
[Alabama Department of Economic and Community Affairs] Gov. Kay Ivey is adding some fuel in the form of a $580,000 grant to a program that helps entrepreneurs and upstart companies get off the ground with their business ideas. The grant will support the Alabama Launchpad, a program directed by the Economic Development Partnership of Alabama Foundation which, through a competitive process, offers entrepreneurs an opportunity to be awarded money to develop their business.

[Human Resources, Department of] Pursuant to the Alabama Youth Residential Facility Abuse Prevention Act #2017-374 (Attachment A), the Alabama Department of Human Resources, shall register any religious, faith-based, or church nonprofit, other nonprofit, or for profit affiliated youth residential facility, youth social rehabilitation facility, community treatment facility for youths, youth transitional care facility, long term youth residential facility, private alternative boarding school, private alternative outdoor program, and any organization entrusted with the residential care of children in any organizational form or combination, whenever children are housed at the facility or location of the program for a period of more than 24 hours.

[Alabama Securities Commission] Kenneth Fitzgerald Lewis, of Hoover, Alabama, was arrested and placed in the Jefferson County Jail, based on a warrant issued after the November 2017 Jefferson County Grand Jury returned a four-count indictment for alleged violations of the Alabama Securities Act. Lewis was released on a $61,000 bond.

The 2017 Alabama Surface Water Assessment Report indicates that even with population growth in the state’s larger metropolitan areas and projected increases in industrial and agricultural use of water resources, Alabama should have a plentiful supply of surface water – rivers, streams, lakes and reservoirs – to meet those requirements through the year 2040.

Madison County, Alabama Man Indicted, Arrested for Alleged Violations of Alabama Securites Act
[Alabama Securities Commission] Edwin Eugene Blalack, a Madison County resident, was arrested on November 14, 2017 by the Madison County Sheriff's Department for his alleged involvement in a securities fraud scheme. Blalack's arrest stems from a November, 2017 Madison County Grand Jury indictment charging him with 17 violations of the Alabama Securities Act. Blalack was subsequently released on a $5,000 bond.

Community Development Block Grant funds will enable the county to construct a storm shelter for residents in the Martintown-Raymond community.
